Terms of Service

By creating an account or using the Service you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Refund Policy. If you don’t agree, do not use the Service.

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) and legally capable of entering into a contract. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

You’re responsible for everything that happens under your account, including the security of your password and the API keys you choose to bring. Notify us at info@intelekt.live as soon as you become aware of any unauthorised use.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service to build, preview, and deploy software through our AI agent platform. You own the projects and code you create with Intelekt, subject to third-party rights in any libraries, dependencies, or model outputs you incorporate.

You may not use Intelekt for any purpose that violates our Acceptable Use Policy, applicable law, or the rights of others. See /acceptable-use for the full list. Examples of prohibited use include building or distributing malware, generating sexual content involving minors, or using the Service to harass, defraud, or stalk.

Intelekt is an interface to third-party AI models including Grok (xAI), and optionally OpenAI, Anthropic, and Google. We do not train foundation models on your prompts or generated code. AI outputs may be wrong, biased, or otherwise unsuitable for your use case — you are responsible for reviewing and validating them before relying on them. We are not affiliated with, endorsed by, or sponsored by xAI, OpenAI, Anthropic, or Google.

If you choose to connect GitHub, bring your own model API key, or otherwise use third-party services through Intelekt, your use of those services is governed by their own terms. We are not responsible for their availability, accuracy, or actions.

Paid plans are billed through our merchant of record, Creem (operated by Armitage Labs OÜ), which collects payment, applies applicable taxes, and remits to us. By purchasing a plan, you also accept Creem’s buyer terms at the time of checkout. Subscriptions renew automatically until cancelled. You can cancel any time from your account in the app or by emailing info@intelekt.live.

Refund eligibility is described in our Refund Policy.

We may suspend or terminate your account if you violate these Terms, the Acceptable Use Policy, or applicable law, or if your account presents a security, fraud, or compliance risk. You may delete your account at any time.

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that AI outputs are accurate, complete, or fit for your purpose.

To the maximum extent permitted by law, Lyvena’s total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

You agree to indemnify and hold Lyvena harmless from any third-party claim arising out of your use of the Service in violation of these Terms or applicable law, including any claim related to content you create or deploy via Intelekt.

These Terms are governed by the laws of the Próspera ZEDE jurisdiction in Honduras, without regard to its conflict of laws principles. Any dispute will be resolved in the competent courts of the Próspera ZEDE jurisdiction, except where applicable consumer law in your country gives you the right to bring claims in your local courts.

We may update these Terms. Material changes will be announced by email or in-app. Continued use of the Service after the changes take effect constitutes acceptance.
